GENERAL SALES TERMS OF DIFFERENT HOTEL GROUP NV
Article 1.
Apart from special written clauses originating from an individual authorised
for that purpose, these general terms shall apply to all commitments undertaken
by Different Hotel Group NV. These conditions are provided on the website
at www.differenthotels.be . This constitutes sufficient notification thereof.
Visit to our facilities or receipt of our documents or services shall be
sufficient for tacit acceptance of said terms.
Article 2.
The services and rates shall be freely determined by Management, which shall
reserve the right to modify them.
Article 3.
The hotel owner shall only be liable for damage, vandalism or theft concerning
items which a hotel guest staying in the hotel brings there and, this, for
a maximum sum of one-hundred times the daily cost of the sleeping accommodations,
except where the item effectively remained in safekeeping, the hotel owner
refused to take securities, money and valuable items into safekeeping or
when the damage is the result of wrongdoing on the part of the hotel owner.
Furthermore, the hotel owner may not be held liable when said damage can
be attributed to the guest him/herself or a person accompanying, visiting
or employed by him/her, in cases of armed theft, or when damage occurred
due to the nature or deficiency of the item. Under penalty of dissolution
of the right to compensation for damages, the hotel guest must report the
damage immediately after their discovery to the hotel owner.
Article 4.
Invoices shall only be sent to customers when requested, except in cases
where issue of an invoice is legally required. The price shall be payable
immediately, net and without discount. n the event of non-payment, the price will be legally increased by default interest at the conventional interest rate of 12% and a lump-sum compensation payment of 10% with a minimum of €75 and a maximum of €1,500.”
Furthermore, any late payment of any invoice from Different Hotel Group NV shall give rise to the right
to suspend all services still ongoing, regardless of their nature. If need
be, Different Hotel Group NV shall have the right to call for annulment.
Such decisions may rightfully be made without proof of default. All items
belonging to the hotel guest, which are found in the hotel, shall be held
until further guarantee of payment of the sums due. Any complaint about the quality of the services received should be submitted within 3 days of the service having been performed. Any complaints concerning the correctness of the invoice must be submitted in writing within 7 days of the invoice being sent.”
Article 5.
If it so wishes, Different Hotel Group NV may legally and without the need
to provide justification subject any order, reservation or service to be
provided or set up to full or partial payment of the sums which are or will
be due to Different Hotel Group NV, also in the form of an advance, deduction
or complete settlement, even in advance.
ARTICLE 6.
All disputes shall fall under the sole competence of the court in Tongeren
and, barring legal clauses stating otherwise, Belgian law shall apply. We
reserve the right to renounce this clause in cases of collection.
